Here is a decision I won at the adjudicator in respect of a PCN I deliberately got to challenge the validity of Westminster's Controlled Parking Zone [sic]

The Appellant has appeared in person to argue this appeal.

The authority's case is that the Appellant was parked in a restricted street during prescribed hours when parked in Bryanston Street on 20 March 2009.

The Appellant has argued that the signage is inadequate and referred me to the Keystone cases 2080274557 and 2090063252.

In the case summary the authority states:

'The City Council would like to note that commencing from the 23 rd  February 2009, the Controlled Parking Zone signage for zones B5, B7, E, F, and G have been made compliant. The relevant evidence confirming this can be made available upon request'  
    
On 22 June 2009, following service of the evidence bundle, the authority produced further evidence in relation to the Controlled Parking Zone signage. In a letter to the Parking and Traffic Appeals Service, dated 18 June 2009, the authority state:

'Please find a copy of a map confirming the whereabouts of the Controlled Parking Zone signage for zones B5, B7, E, F and G along with an example of the time plate that is displayed.'
    
It is to the map that I now turn.

First, the map entitled 'CPZ Signs for Parking Zone F' does not show a single zone identified as F and appears to create two zones with a mixture of sub zones labelled with different letters and numbers.

Secondly, the authority's letter suggests that there are 5 separate zones B5, B7, E, F and G. The map does not support this.

Thirdly, B5 appears to have signage that encompasses not just B5 as a discreet zone but includes B7, F4 and F1.

Fourthly, F3, which is where the Appellant was parked, appears separated from F1 and F4 and is joined to F2, F5, F6 and E1 and G1 without any separating signage on their respective boundaries.

Finally, in my judgment, the mixture of letters and numbers cause doubt about whether the authority's Controlled Parking Zones are properly signed with the required entry signs.


The appeal is allowed.
