Here is my suggested response to a letter asking for money in respect of a Private Parking Ticket.

"Thank you for your letter dated xxx.

Your letter requests a fine of £xxx - a fine is illegal under UK law.

If you are claiming that there is a contract between the driver of the vehicle and yourselves then I must point out the provisions of the the The Unfair Terms in Consumer Contracts Regulations 1999 which specifically provides under paragraph 5 (1) "A contractual term which has not been individually negotiated shall be regarded as unfair if, contrary to the requirement of good faith, it causes a significant imbalance in the parties' rights and obligations arising under the contract, to the detriment of the consumer"

The effect of these provisions means that if there was a contract, which is in dispute, then you are only entitled to payment of an amount which accurately reflects the loss of income you may have suffered arising from that alleged contract.

In the circumstances I am offering you on a without prejudice basis only the sum of £xx in full and final settlement of any and all claims you have against me.  I should point out that if you bank or negotiate this cheque this will be acceptance of this offer.

Whilst writing I would advise you that the threats to collect money contained in your letter of of xxxx constitute a criminal act under The Administration of Justice Act 1970.  These criminal threats must cease immediately.

 If you do not accept the above without prejudice payment and pursue this matter through the courts then I shall bring to the court's attention this letter.

Note: Insert the apprpriate information or figures where xxx is shown.  I would suggest that you do not offer more than £8 - I am even tempted to say do not offer more than £3 or £4.  Offer what would be the cost to park for 1/2 hour or 1 hour.
